Job Description

Role Purpose

Reporting to the Managing Executive Head of Legal and Compliance, the position holder will focus upon the management of policy and regulatory matters to enable the company to achieve its commercial strategy and pro-actively mitigate risks for the commercial launch and operations of the company, contributing to Digital DRC objectives of the country.

Accountabilities Key Activities / Decision Areas

Technology & Economic regulatory support

  • To manage (working with other functions) regulatory and public policy matters required for commercial launch and operations of the company.
  • Establish, manage and maintain positive relationships between Company, the Regulator, Government other telecommunication industry players on regulatory and public policy matters, contributing to Digital DRC objectives and ensuring that the company’s strategy objectives are achieved, and risks mitigated.
  • Managing regulatory and policy interventions which could positively or adversely impact Company’s strategy and reputation.
  • Legislation and Policy Watch - Analyse new legislation, regulation, and government policies that may affect Company. Implement engagement strategies to manage implementation. Engage with the relevant Government department, regulatory authority, and Parliamentary Committee for changes in the proposed legislation and policies.
  • Keep up to date and ensure new regulatory and public policy global developments that affect Vodacom DRC are incorporated into our strategy, programmes, and activities. Actively participate in Vodafone External Affairs community on regulatory and public policy issues.

Telecoms specific taxes

  • Avert or minimise adverse Telecom laws like sector-specific taxes.
  • Manage telecoms specific taxes: by maintaining a database of taxes and fees and providing advice for their reduction.
  • Monitor the landscape and engage with the relevant stakeholders (NRA, Parliament, Min of Finance, GSMA and others); Proactively monitor the budget cycles.

Regulatory compliance, governance, and reporting

  • Ensure compliance with the License terms and conditions applicable to the company including Vodacom and Vodafone policies
  • Ensure compliance with the Competition Law (review compliance, monopoly and dominance designation, ex-ante and ex-post remedies, access regulation, unbundling of services, etc) and mitigate of the potential risks.
  • Develop and implement internal company processes (working with relevant functions) that will ensure compliance with licence terms and Regulations.
  • Compile Regulatory and Public Policy updates reports and regulatory risk reports for internal governance.

Technical / Professional Expertise

  • University decree in law, ideally Economy, Public affairs. Others considered if experience as listed.
  • Experience in working in telecommunications or in a regulated industry: 6 – 8 years+
  • Knowledge of Congolese telecoms and digital industry will be an advantage.
